Terms of Service

These Terms are an agreement between you and the operator of MuslimahFirst, a sole trader based in Queensland, Australia (ABN 50 686 098 448) ("we", "us", "our"). They apply to the MuslimahFirst app on Android, iOS and the web (app.muslimahfirst.com) and to this website (together, "the Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Please read in particular section 3 (Your safety) and sections 10 to 13, which explain what we do not promise and how our liability is limited. Nothing in these Terms takes away your rights under the Australian Consumer Law (see section 11).
1. Agreement and Eligibility
To use MuslimahFirst you must:
- be at least 18 years old. We ask for your date of birth and will not create a profile for anyone under 18. If we believe a member is under 18, we will remove them. See our Child Safety Standards;
- be a Muslim seeking marriage. MuslimahFirst is intended for Muslim men and women who are looking for marriage (nikah). It is not for casual dating, friendship, networking or business;
- hold one account only, in your own name, and give truthful, accurate and current information about yourself (including your age, photos and intentions), and keep it up to date;
- be legally able to enter into this agreement, and not be prohibited from using the Service under the laws that apply to you;
- never have been convicted of a sexual offence, and not be required to register as a sex offender in any country; and
- not have been previously removed or banned from the Service, unless we have agreed in writing that you may return.
You must not create an account for someone else, use another person's photos or details, or let anyone else use your account. You are responsible for keeping your sign-in details secure and for everything done through your account. Tell us straight away at support@muslimahfirst.com if you think someone else has accessed it.
2. How MuslimahFirst Works, and What We Do Not Promise
- Discover and matches. You can browse member profiles in Discover and use filters. If you and another member both express interest, you match. Only matched members can message each other.
- Sisters message first by default. A brother cannot open a conversation with a sister unless she chooses to allow it. Each sister has a setting to let brothers write first; it is off unless she turns it on, and she can change it at any time.
- Photos. Photos are visible to other members by default. A sister can choose to blur her photos until she matches, and a brother can choose to show his only after a match; either can change this at any time. Blurring means the app does not display the photo to other members. It is a feature of the app, not a guarantee against every possible way a determined person might copy an image, so only upload photos you are comfortable sharing.
- Wali features (optional). A sister may invite a wali (a male guardian such as her father, brother or uncle) by email. Depending on the access level she chooses, her wali can view her matches and conversations through a private link, flag messages that concern him, or send one introduction message to a match. If she asks him to chaperone a conversation, her match is told that her wali can read it. With her approval on each call, her wali can join a call with his microphone. She can change his access level or remove him at any time.
- Voice and video calls. Matched members can call each other in the app when calling is available. Calls may be time-limited or temporarily unavailable, and we may switch calling off. We do not record calls.
- Translate. You can translate a message into your language. Translations are produced by a machine translation service and may be inaccurate. Do not rely on a translation for anything important; ask the other member what they meant.
- Optional photo verification. Members can choose to verify by taking photos in the app, which a person on our team compares with their profile photos. A verified badge only means that, when we checked, the photos taken in the app appeared to match the profile photos. It does not confirm a member's name, age, marital status, religion, background, intentions or character, and members who have not verified can still use the Service.
- Profile of the Week. An active brother's profile may be highlighted to sisters at the top of Discover, inside the app only. Brothers can opt out at any time in Profile → Profile of the Week. A sister is only ever featured if she switches this on herself. Featuring never changes who can see your photos, and we never use member profiles on our website, in advertising or on social media without asking first.
What we do not promise. We provide a place for Muslims seeking marriage to meet. We do not promise that you will receive matches, replies, meetings or a marriage proposal, or that you will marry anyone. We do not run criminal background checks, identity checks or checks of marital status on members, and we cannot guarantee that any member is who they say they are or that what they tell you is true. Optional verification is not a guarantee. We are not a marriage agency, matchmaker, background-check service or religious authority, and nothing in the Service is a religious ruling. Any decision to talk to, meet or marry someone is yours, and we encourage you to involve your family or wali.
3. Your Safety
You are responsible for your own safety and for your interactions with other members, both in the app and outside it. Please:
- take your time, and be cautious with anyone who rushes you, avoids a video call or asks to move the conversation off the app early;
- never send money, gifts, gift cards, cryptocurrency, or bank or card details to anyone you meet through the Service, however convincing their story;
- involve your family or wali, meet for the first time in a public place, tell someone you trust where you are going, and arrange your own transport;
- do not share your home address, workplace or financial details until you are sure you can trust the person; and
- report anyone who breaks these Terms or makes you feel unsafe (see section 5).
We are not responsible for the conduct of any member, on or off the Service, except to the extent the law makes us responsible (see sections 11 and 12). If anyone is in immediate danger, call your local emergency number (000 in Australia). For urgent safety concerns about a member, email safety@muslimahfirst.com.
4. Your Conduct (Community Guidelines)
You agree not to:
- ask any member for money, gifts, loans, bank or card details, or promote investments, cryptocurrency or any other scheme (scams);
- harass, bully, threaten, stalk, insult or pressure anyone, or keep contacting someone who has not replied or has asked you to stop;
- post or send hateful content, including content that attacks people because of their race, ethnicity, nationality, sect, gender, disability or any other personal characteristic;
- send sexual or explicit content, or content that is violent, unlawful or that encourages unlawful acts;
- involve, discuss or seek contact with anyone under 18, or post any content that sexualises or endangers a child;
- impersonate any person, use someone else's photos, or give false information about your age, marital status or intentions;
- use the Service for commercial purposes, including advertising, selling, recruitment, soliciting, or promoting another app, group, website or service, or spam other members;
- scrape, copy, harvest or collect other members' information, or use bots or automated tools to access the Service;
- copy, modify, reverse engineer, decompile or try to extract the source code of the app, or get around the app's privacy, photo, messaging or safety settings;
- interfere with, overload or attempt to break the Service or its security;
- hold more than one account, or create a new account after we have suspended or banned you (ban evasion); or
- post or share anything that is illegal, or that you do not have the right to share, or break any law while using the Service.
Consequences. If we reasonably believe you have broken these Terms or are a risk to other members, we may remove content, issue a warning, place your account on hold, restrict features, suspend your account or ban you permanently. We may also report conduct to police or other authorities. Where it is needed to protect members or to comply with the law, we can act immediately and without notice. Where it is safe and reasonable to do so, we will tell you why.
5. Reporting, Moderation and Safety Records
- You can block or report any member from their profile or your chat. Blocking stops them contacting you.
- Reports are reviewed by a person (an admin). A single report that a member is under 18 or has asked for money places that profile on hold straight away: it is hidden from Discover and cannot message or call while we review it. A hold is not a ban, and it is lifted if the report is not upheld.
- Reports from more than one member can lead to an automatic ban, which an admin reviews and can reverse. Our systems also check messages for signs of scams, such as requests for money, and may show a warning to the person receiving the message and flag it for our team.
- Safety records are kept after deletion. Safety reports are kept after an account is deleted, so we can still act on scams and abuse. That includes reports you made and reports made about you. Where messages sent to you were flagged as a possible scam, the flag is kept but your account details are removed from it. If an account was banned, a short safety record (first name, birthday, city, photo fingerprints and a one-way hash of the sign-in email) is kept so the same person cannot simply rejoin. If you had warnings and delete your profile but keep your sign-in, the warnings come back when you set up a new profile. See Delete your account.
- We use these records to detect and stop ban evasion. If we find that a banned person has created a new account, we may close it without notice.
- We are not obliged to monitor or pre-screen content, and we cannot review every message, but we may review, remove or act on any content or account that we reasonably believe breaks these Terms. If you think we have made a mistake, email support@muslimahfirst.com and we will look at it again.
6. Your Content
You own the photos, text, voice notes and messages you post ("your content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, display, transmit, translate (when a member asks the app to translate it) and otherwise process your content only as needed to operate, provide and keep safe the Service for you and the members you interact with. This includes moderation and, where it applies to you, Profile of the Week inside the app (see section 2). We do not use member profiles on our website, in advertising or on social media without asking first.
This licence ends when you delete the content or your account, except for copies we keep for legal or safety reasons as described in section 5 (for example, content attached to a report). You are responsible for your content. You confirm that you have the right to post it, that it is accurate, and that it does not break these Terms or the law or infringe anyone else's rights. We may remove any content that we reasonably believe breaks these Terms. We are not responsible for content posted by other members.
7. Third-Party Services
The Service relies on other companies' services, including the Apple App Store and Google Play (to download the app and for any purchases), Firebase by Google (sign-in, hosting and data storage), a machine translation service (Google Cloud Translation), a real-time calling provider (LiveKit), Expo (push notifications), GIPHY (GIFs and stickers) and RevenueCat (for in-app purchases, if paid features are ever offered). Your use of those services may also be governed by their own terms and privacy policies. We are not responsible for third-party services, websites or content that we do not control, or for their availability, except to the extent the law makes us responsible.
Apple. If you downloaded the app from the Apple App Store, these Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claim relating to it (including product liability, legal compliance or intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store's usage rules.
8. Fees
MuslimahFirst is currently free. There are no paid subscriptions switched on and we do not charge you anything. We may introduce optional paid features in future. If we do: we will tell you in the app before any charge applies; the price will be shown clearly before you buy; purchases will be billed and processed by the Apple App Store or Google Play, and their terms will apply to the purchase (including how to cancel any subscription); and refunds will be handled under the store's refund policy and your rights under the Australian Consumer Law. Nothing will be charged without your agreement.
9. Our Intellectual Property
The MuslimahFirst name and logo, the app, this website, and their design, text, graphics and software (other than members' content and third-party material) belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence, which we can withdraw, to use the app and website for your own non-commercial use in line with these Terms. You must not copy, modify, distribute, sell or create works based on any part of the Service, or use our name or logo, without our written permission. If you send us feedback or suggestions, we may use them freely without any obligation to you.
10. Disclaimers
Subject to section 11, and to the extent permitted by law, the Service is provided "as is" and "as available". We do our best to keep it running well, but we do not promise that the Service will be uninterrupted, timely, secure or free of errors or bugs, that any particular feature will stay available, that information shown in the Service is complete or accurate, or that the Service will meet your particular needs. We may change, pause or discontinue the Service or any feature at any time. If we close the Service entirely, we will give reasonable notice where we can.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where our liability for failing to comply with such a guarantee can be limited, it is limited (at our option) to supplying the services again or paying the cost of having them supplied again.
12. Limitation of Liability
Subject to section 11, and to the maximum extent permitted by law:
- we are not liable for any indirect or consequential loss, or for any loss of profits, revenue, data, opportunity or goodwill, arising out of or in connection with the Service or these Terms;
- we are not liable for the conduct of any member or other person, on or off the Service, for content posted by other members, or for anything that happens when you communicate with or meet someone you found through the Service;
- we are not liable for any loss caused by a third-party service (see section 7), or by events outside our reasonable control; and
- our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the greater of the total amount you paid us in the 12 months before the claim arose and AUD $100.
This section does not limit our liability for our own fraud or deliberate wrongdoing, or any liability that cannot lawfully be limited.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against any claim, demand, loss, damage, cost or expense (including reasonable legal costs) brought by a third party or incurred by us, arising out of your content, your conduct on or off the Service in connection with it, or your breach of these Terms or of any law. This indemnity is reduced to the extent the loss was caused by our own breach of these Terms, negligence or wrongdoing.
14. Suspension and Termination
- By you. You can stop using the Service and delete your account at any time in the app, or by email — see Delete your account.
- By us. We may suspend or close your account, with or without notice, if you break these Terms, if we reasonably believe you are a risk to other members or to the Service, if we suspect fraud or ban evasion, or if the law requires it. Where it is safe and reasonable to do so, we will tell you why. We may also close accounts that have been inactive for a long time, after giving notice by email where we can.
- What happens next. When your account ends, your right to use the Service ends. Sections 3, 5 (safety records), 6 (for content we keep), 9 to 13, 17 and 18, and any other terms that by their nature should continue, survive the end of your account.
15. Privacy
Our Privacy Policy explains how we collect, use and protect your personal information, and our Delete your account page explains what is deleted and what is kept when you leave. Please read them; they form part of how the Service works.
16. Changes to These Terms
We may update these Terms from time to time, for example when we add features or the law changes. We will notify you of significant changes through the app or by email before they take effect. The "Last updated" date at the top of this page always shows the current version. If you keep using the Service after a change takes effect, the updated Terms apply; if you do not agree, you can stop using the Service and delete your account.
17. Disputes and Governing Law
If you have a problem with the Service, please contact us first at support@muslimahfirst.com and tell us what has happened. We will both try in good faith to resolve it informally within 30 days. This does not stop either of us seeking urgent relief from a court, and it does not stop you contacting a consumer protection agency (such as the Queensland Office of Fair Trading or the ACCC) or using any other right you have under the law.
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If you live outside Australia, you may also have rights under the laws of your country that these Terms do not take away.
18. General
- Entire agreement. These Terms, together with our Privacy Policy and Child Safety Standards, are the whole agreement between you and us about the Service.
- Severability. If any part of these Terms is found to be invalid or unenforceable, it will be read down or removed to the extent necessary, and the rest of the Terms will continue to apply.
- No waiver. If we do not enforce a right under these Terms straight away, we have not given it up.
- Assignment. We may transfer our rights and obligations under these Terms, for example to a company we set up to run the Service or to a new owner of the Service, and we will tell you if we do. This will not reduce your rights under these Terms or the law. You may not transfer your account or your rights under these Terms to anyone else.
- Events outside our control. We are not responsible for any delay or failure to provide the Service caused by events outside our reasonable control, such as outages at our service providers, internet or power failures, natural disasters, pandemics, industrial action or government action.
- Relationship. Nothing in these Terms creates a partnership, employment or agency relationship between you and us.
- Notices. We may send you notices through the app or to the email address on your account. You can send notices to us at support@muslimahfirst.com.
